Deputies vote amendments envisaging fines from BGN 1000 to BGN 5000 for a contracting authority that has not fulfilled its obligations
A fine from BGN 1000 to BGN 5000 for a contracting authority, which has not fulfilled its obligation to provide everything that is necessary for the start of the construction works is envisaged by the amendments adopted by the Parliament at the second reading of the Spatial Development Act. The proposal made by the movers to double the amount of the fine to BGN 5000 – BGN 10 000 for officials who have not fulfilled or have not fulfilled properly the duties entrusted to them by this law, or the acts for its application, or of all other existing rules and regulations or mandatory recommendations based on the latter related to the design of and the construction works of a building, was rejected. The bill has introduced a fine of BGN 100 to BGN 300 for a contracting authority who fails to request a technical passport of the building to be drawn within the terms stipulated by the law. The amendments foresee a fine of BGN 5000 to BGN 30 000 for the manufacturers of construction materials not in conformity with the standard requirements.
The Deputies have entrusted the Head of the National Construction Supervision Directorate with the power to stop the execution and the access to the construction site of first to third category buildings, if the works are done without the necessary permit or with considerable deviation from the granted permit, as well as in cases when construction materials not conformant to the required are used. The right to halt construction works from third to sixth category construction sites was given to the municipal and district mayors or to the persons authorized by them.
