Claims for illegally acquired assets to be precluded by prescription after 10 years
The Parliament has decided that probes of the Commission for Forfeiture of Illegally Acquired Assets will be precluded by prescription after 10 years since the acquisition of the assets. The rules were adopted with the first reading of the amendments to the Law for Forfeiture of Illegally Acquired Assets.
According to them the term of 10 years is conformant to the Constitutional Court’s decision proclaiming part of the law contrary to the Constitution. The bill suggests the rights of the state to investigate assets deemed acquired illegally to extinguish by prescription after 10 years of the acquisition of the assets. This term is also in accordance with the rules of the Tax and Social Insurance Procedure Code and the Ownership Act. The law establishes a new chapter regulating the compensation on the part of the state of crime victims.
